Attachment to Short-Term Rental Booking Agreement

Effective Date: 1/1/2026    

These Rules and Regulations (“Rules”) are incorporated by reference into the Short-Term Rental Agreement between the Property Manager (“Manager”) and the Guest(s) named therein. All Guests and their invitees are required to read, understand, and comply with these Rules. Violation of any Rule may result in immediate termination of the rental, forfeiture of the security deposit, and/or additional charges.

1. Occupancy & Authorized Guests

  1. Maximum occupancy is 23 persons, including children. Exceeding this limit is strictly prohibited.
  2. Only individuals listed on the rental agreement are authorized overnight guests. Day visitors are welcome, but must not exceed 10 persons unless pre-approved by the Manager.
  3. The primary Guest must be at least 25 years of age and must be present for the entire rental period.
  4. Guests are responsible for the conduct of all persons on the property during the rental period.
  5. Unauthorized subletting, assignment, or re-listing of this property on any platform is prohibited.
  6. The operation of this short-term rental shall not interfere with the residential character of the premises nor surrounding properties.
  7. All rental occupants and guests must act peaceably and not in violation of New York State Penal Law or in violation of the Zoning Code of the Town of Bolton..
  8. Overnight guests shall not exceed the amount indicated on the permit located conspicuously within five (5) feet of the main entry to this rental

2. Check-In & Check-Out

  • Check-in time is 4:00 PM and check-out time is 11:00 AM]. Early check-in and late check-out must be pre-approved in writing and may incur additional fees.
  • Guests must report any pre-existing damage or maintenance issues within 2 hours of check-in via the contact methods supplied for the Manager.
  • Upon check-out, Guests must: remove all personal belongings, place all trash in designated receptacles, start the dishwasher with any dirty dishes inside, leave all windows and doors locked, and return all keys/access devices to their designated location.
  • Failure to vacate by the check-out time may result in a late departure fee of $200 per hour and may affect subsequent bookings.

3. Noise & Quiet Hours

  1. Rental occupants and their guests shall be required to conduct themselves in accordance with the Town of Bolton Noise Ordinance #22 and maintain quiet at this premises between the house of 10:00PM and 7:00AM.
  2. Therefore, quiet hours are from 10:00 PM to 7:00 AM. During this time, outdoor noise (music, gatherings, loud conversation) must be kept to a minimum out of respect for neighboring properties.
  3. Amplified outdoor music or sound equipment is prohibited at all times without prior written consent from the Manager.
  4. Guests must comply with all applicable local noise ordinances. Complaints to local law enforcement may result in immediate termination of the rental.
  5. No firework displays shall be permitted on this property.  Reports of firework displays to property Manager may result in immediate termination of the rental.

4. Lake, Waterfront & Water Activities

  1. All lake use is at the Guest’s own risk. The Manager assumes no responsibility for injuries or accidents occurring on or near the water.
  2. U.S. Coast Guard-approved life jackets are available on-site and must be worn by all children and non-swimmers at all times near or on the water.
  3. Swimming after dark is strictly prohibited.
  4. Guests must observe all New York State and local lake safety regulations, including boating speed limits and wake restrictions.  Please note this property is located by clearly marked buoys to the south and north indicating a “no wake” 5MPH speed limit for boats and watercraft.
  5. Any watercraft provided with the property must be operated only by guests with a valid New York State Boating Safety Certificate (required for operators born after January 1, 1993, per NYS Navigation Law).
  6. Guests may not bring or launch their own personal watercraft, boats, kayaks, or other vessels without prior written Manager approval. All vessels must be properly registered per NYS law.
  7. Fishing is permitted in accordance with current New York State fishing license requirements. All Guests who fish must possess a valid NYS fishing license.
  8. The dock and waterfront areas must be kept clear of trash and personal belongings. Dock furniture must be returned to its original position upon checkout.
  9. No diving from the dock unless explicitly authorized and designated safe by the Manager. Guests assume all risk.

5. Fire Pit, Bonfires & Open Flames

  • The fire pit may only be used in accordance with all applicable New York State and local open burning regulations. Guests are responsible for checking current burn bans before lighting any fire.
  • Fires must never be left unattended and must be fully extinguished before Guests retire for the evening or leave the property.
  • Only clean, dry firewood may be burned. Burning trash, treated wood, or prohibited materials is strictly forbidden.
  • A water source or fire extinguisher must be readily accessible whenever a fire is burning. Extinguisher locations are marked on the property.
  • No fire pits, chimineas, or portable fire devices other than the designated fire pit may be used on the property.
  • Fireworks and sparklers of any kind are strictly prohibited on the property.

6. Pets

  • Pets are not permitted. If permitted, a pet fee of $75 per night, per pet applies, and must be paid prior to arrival. Certified service animals are exempt from this clause.
  • Approved pets must be kept on a leash when outdoors and are not permitted on furniture or bedding.
  • Guests are responsible for cleaning up after pets both inside the home and on the property grounds.
  • Any damage caused by pets will be charged to the Guest and deducted from the security deposit.
  • Pets must not be left unattended inside the property for extended periods.

7. Smoking & Vaping

  • Smoking, vaping, and the use of tobacco or cannabis products are strictly prohibited inside the property at all times.
  • Smoking is not permitted anywhere inside of the house or on porches. All cigarette butts must be properly disposed of in designated containers — never on the ground or near the waterfront.
  • Evidence of indoor smoking will result in an automatic cleaning/remediation fee of $250 charged to the Guest.

8. Parking & Vehicles

  • A maximum of 8 vehicles are permitted on the property. Vehicles must be parked in designated areas only.
  • Parking on public roads, neighboring properties, or blocking driveways is prohibited.
  • RVs, campers, trailers, and commercial vehicles are not permitted on the property without prior written approval.

9. Property Care & Use

  • Guests must treat the property and all furnishings with care. Any damage beyond normal wear and tear will be charged to the Guest.
  • Furniture, grills, and other items must not be moved between indoors and outdoors without Manager permission.
  • Do not use the property’s address for any commercial activities, events, parties, or gatherings beyond the approved guest count without prior written consent.
  • Guests must not tamper with, disable, or remove any smoke detectors, carbon monoxide detectors, security cameras (exterior only), or safety equipment.
  • Garbage and recycling must be sorted and placed in the proper designated containers. When placed outside, garbage and recycling shall be put securely in the covered receptacles. Garbage pickup occurs on Mondays. Guests staying over Sunday night are responsible for placing bins at the curb Sunday evening for the Monday morning collection time.
  • Do not flush anything other than toilet paper down the toilets. The property uses a grinder pump to a municipal system. Flushing wipes, feminine products, or other items will impair the grinder pump and, if a repair is needed and deemed caused by prohibited items, the repair fee will be charged to the Guests.
  • All doors and windows must be locked when Guests leave the property.

10. Prohibited Activities

  • Parties, events, or gatherings with more guests than the approved maximum occupancy are strictly prohibited.
  • Illegal activities of any kind are prohibited on the property.
  • Use or possession of illegal controlled substances on the property is prohibited.
  • Discharge of firearms, air guns, or any weapons on the property is prohibited.
  • Introduction of invasive species to the lake (e.g., via improperly cleaned watercraft or bait buckets) is prohibited and may be a violation of NYS Environmental Conservation Law.
  • Guests may not alter, modify, or make repairs to the property or any of its systems without prior written Manager authorization.

11. New York State Legal Compliance

  • This rental is subject to all applicable New York State laws and regulations, including but not limited to the NYS Multiple Dwelling Law, NYS Navigation Law, NYS Environmental Conservation Law, Town of Bolton Ordinances and other applicable local municipal codes.
  • Guests are responsible for paying any applicable local occupancy taxes if not already collected by the booking platform or Manager.
  • Guests must comply with all posted local municipal short-term rental ordinances, which may include occupancy limits, noise restrictions, or parking regulations specific to the municipality in which this property is located.
  • New York State requires that carbon monoxide and smoke detectors be present and functional in the property. Guests must not tamper with these devices and must notify the Manager immediately if an alarm sounds or a device appears non-functional.

12. Safety & Emergencies

  • In the event of an emergency, call 911 immediately or the Town of Bolton Police at 518-644-9717, Warren County Sheriff at 518-743-2500, or New York State Troopers at 518-583-7000. The property address for emergency services is: 2 Green Isle Ln, Bolton Landing, NY 12184. 
  • The location of the first aid kit, fire extinguishers, circuit breaker, and main water shut-off are noted in the Welcome Book provided on-site.
  • Guests must notify the Manager immediately of any accidents, injuries, property damage, or emergency situations.
  • If the property must be evacuated for any reason (weather, emergency), Guests must do so promptly and contact the Manager.

13. Security Deposit & Damages

  • A refundable security deposit of $1,000.00 is required and will be held against damages, excessive cleaning, rule violations, or unpaid charges.
  • The security deposit will be returned within 3 days of checkout, minus any applicable deductions, with an itemized statement if deductions are made.
  • Guests are financially responsible for any damage exceeding the security deposit amount.
  • Guests must report damage immediately upon discovery. Unreported damage discovered after checkout may still be charged to the Guest.

14. Indemnification & Assumption of Risk

Guests acknowledge that use of the lake, dock, watercraft, fire pit, and other property amenities involves inherent risks. Guests voluntarily assume all such risks and agree to indemnify, defend, and hold harmless the Manager and Owner from and against any and all claims, losses, damages, or liabilities arising from Guests’ use of the property and its amenities, except to the extent caused by the Manager’s gross negligence or willful misconduct.

Acknowledgment & Agreement

By signing the Short-Term Rental Agreement to which these Rules are attached, Guest acknowledges having read, understood, and agreed to comply with all of the above Rules and Regulations.
